Anti-spam policy

We respect the ethical approach to email marketing and follow strict anti-spam rules. We only send all campaigns with the prior consent of the recipient. We do not send spam and we ensure compliance with legislation including GDPR and the CAN-SPAM Act.

At Emailkampane.cz we value the trust of our users and recipients of email messages. We are committed to strict anti-spam measures and actively fight spam. This policy outlines our policies and procedures for preventing and dealing with spam.

What is SPAM?

We define spam as unsolicited, bulk email messages that recipients do not want to receive and for which they have not given their explicit consent. Spam can take many forms, including unsolicited advertising messages, chain emails, phishing attempts and other unwanted messages.

Our Commitments:

  • Respecting consent: We only send email messages to recipients who have given us their voluntary and informed consent (opt-in). We provide a transparent consent process and allow recipients to withdraw their consent at any time (opt-out).
  • Spam prevention: we implement technical and organisational measures to minimise the risk of spam being sent from our systems. These include, for example, sender authentication, content filtering and monitoring for unusual activity.
  • Cooperation with authorities: We actively work with Internet Service Providers (ISPs), anti-spam organizations and law enforcement agencies to identify and combat spam.
  • User education: We provide our users with information and recommendations on proper emailing practices to avoid inadvertently sending spam.

What we expect from our users:

  • Obtaining Consent: Users of our services are required to obtain explicit consent from recipients before sending any bulk email message. Consent must be verifiable and include clear information about the purpose of the messages and the ability to opt-out.
  • Respecting unsubscribe requests: Users must respond promptly to unsubscribe requests and ensure that recipients who do not wish to receive further communications are not contacted further.
  • Content transparency: Email messages sent must clearly identify the sender and contain relevant information. Masking the identity of the sender or providing misleading information is prohibited.
  • Prohibition of spam: It is strictly prohibited to use our services to send spam of any kind. Violation of this policy may result in immediate account termination and other legal action.

SPAM monitoring

We take our anti-spam policy very seriously, so we reserve the right to suspend services or even completely refuse and terminate services without refund upon reasonable suspicion of spamming by our users. The main indicators we monitor include:
  • (In)complete identification of the account holder and/or campaign sender
  • Failure to indicate or incorrectly indicating the unsubscribe option
  • Failure to label commercial messages
  • Repeated registrations
  • Registering with fake or one-time data
  • Importing a purchased database
  • Significant level of invalid addresses in the database (if the number of invalid addresses exceeds 1%)
  • Databases containing known spam traps (targeted traps)
  • Obnoxious campaign content (phishing links, vulgar text, fake offers, explicit or otherwise defamatory content)
  • Bounce rate - undeliverable email addresses higher than 2%
  • Unsubscribe rate - higher than 2%
  • Generic email addresses - more than 3% of the database
  • Individual reports of spam by recipients, freemail providers, ISPs/ESPs, Authorities or receiving server administrators
  • Level of marking as SPAM by freemail providers
  • Domain blacklists
For new accounts, or for accounts showing an unusual change in normal behaviour, we reserve the right to suspend the sending of the campaign until it has been checked by the operator (no later than "Next business day" mode), and likewise reserve the right to contact you for possible remedy or not to send the campaign.
For the avoidance of doubt - the above rules are intended as a summary of possible actions and do not create any obligation on us as a Service Provider, nor do they impose any liability on us for your content or actions taken by you. All responsibility for compliance with legal and ethical principles rests solely with you as a user of the Service.
